ABA Model Standards of Conduct

Mediation Philosophy

Each mediator has his or her own unique style.  Some are more “facilitative” and focus on allowing the parties to voice their concerns as a way of improving their relationship.  Others are more “evaluative” and focused on the merits of the case.

While both approaches can be useful, I believe the ultimate measure of a successful mediation is the actual resolution of the dispute.  As such, my focus is on assisting the parties reach an agreement.

Issues Mediated

Include: Legal actions involving discharge, discipline, all forms of discrimination (e.g., race, color, religion, sex/sex harassment, national origin, disability, sexual orientation, marital status, veteran status, political beliefs, etc.), retaliation/whistleblowing, pay & benefits, performance appraisals, demotions, layoffs/recall, tenure/reappointment, work hours/schedules/assignments, working conditions/work orders, wrongful discharge/termination.

I have also mediated wage & hour class action cases.

Fees*
  • Legal Action Fee (Single Plaintiff): $7,000 for up to 8 hours (hourly rate after 8 hours).
  • Class Action Fee (Multiple Plaintiffs): $10,000 per 8-hour day (hourly rate after 8 hours).
  • Travel Costs: The cost of airfare or mileage, rental car, hotel, and meals will be charged for in-person hearings.
  • Cancellation/Postponement Fee: $2,000, plus any unreimburseable expenses (e.g., airline tickets), will be charged for cases cancelled or postponed less than 28 days prior to the mediation date.  This amount will be paid by the party postponing or cancelling the mediation unless otherwise agreed to by the parties in writing.

* Cost and fees are split equally by the parties unless otherwise specifiedFees are due at least one week prior to the mediation hearing.
